Why Do You Need a Lawyer to Look Over Your Housing Contract?

April 4, 2022 by admin

Your housing contract is a serious legal document. It lays out the terms and conditions of your lease agreement and can be used as evidence in the event of a dispute. That’s why it’s important to have a lawyer look over your contract before you sign it.

What Are Different Types of Housing Contracts?

There are three main types of housing contracts: fixed-term, periodic, and indefinite. A fixed-term contract is for a specific amount of time, usually one year. At the end of the term, the tenant must either leave or sign a new contract. A periodic contract is month-to-month or week-to-week. The tenant can leave at any time by giving the landlord proper notice. An indefinite contract does not have a specific end date and can be terminated by either party with proper notice.

What are the Terms of My Housing Contract?

Your housing contract will likely include the following terms:
  • The amount of rent and when it’s due
  • The amount of security deposit and when it’s due
  • Who is responsible for repairs and maintenance
  • Who pays for utilities
  • What happens if you break the contract
  • What happens if the landlord breaks the contract

What Does a Lawyer Do?

A lawyer can review your contract and make sure that all of the terms are fair and reasonable for both parties.

Why Have a Lawyer Look Over Your Housing Contract?

Below are seven reasons why you need a lawyer to look over your housing contract.
  1. Your contract lays out the terms and conditions of your lease agreement. A lawyer can make sure that the terms of the contract are fair and reasonable for both you and your landlord.
  2. A lawyer can help you understand the terms of your contract before you sign it. This is especially important if you’re not familiar with legal jargon.
  3. A lawyer can help you negotiate better terms in your contract. If you have a lawyer representing you, your landlord may be more likely to offer you a better deal.
  4. A lawyer can protect your interests if there’s a dispute with your landlord. Your contract will be used as evidence in court, so it’s important to have a lawyer who knows what they’re doing. If there’s a problem with your rental unit, your lawyer can help you get it fixed.
  5. A lawyer can help you if you need to terminate your lease agreement. If you need to move out early, your lawyer can help you negotiate a termination agreement with your landlord.
  6. A lawyer can help you if you need to sue your landlord. If your landlord breaks the law or violates your rights, you may need to take legal action. A lawyer can help you file a lawsuit and represent you in court. If your lawyer is already familiar with your housing contract, they will be able to more efficiently help you to take action.
  7. A lawyer can advise you on other important legal documents related to your housing situation. If you’re buying a house, or if you’re considering renting out your property, a lawyer can help you with those transactions too.
